Euro defeat for Merkel? Only time will tell

BERLIN (Reuters) - At first glance, the big winners from Europe's latest euro-saving summit were the leaders of Italy, Spain and France.

By banding together in a powerful coalition to challenge Germany, the high-stakes meeting seemed to show, Mario Monti, Mariano Rajoy and Francois Hollande were able to wring major crisis-fighting concessions from a suddenly soft Angela Merkel.

But if the euro zone is still intact years from now, the marathon session in Brussels may be remembered as much for what the German leader extracted from her combative partners as for the bitter policies she was forced to swallow.

"That Monti, Rajoy and Hollande are now happily selling this as a victory says a lot about the diplomatic skills of Ms. Merkel," said Holger Schmieding of Berenberg Bank.

With her plans hinging on parliamentary votes scheduled for hours after the summit, Merkel took an unyielding public stance in advance. That made it appear as if she had retreated, when in fact she may have got much of what she wanted.

Merkel's biggest concession in the early morning hours of Friday was to agree to give the euro zone's new permanent rescue fund, the European Stability Mechanism (ESM), the power to inject aid directly into stricken banks.

According to the post-summit narrative, she flinched after Monti threatened to withhold his backing for a new European "growth pact" Merkel desperately needed to win crucial votes in the German parliament later that day.

Several senior European officials in Brussels told Reuters however that Merkel had in actual fact signaled privately in the days before the summit that she could live with the idea of direct bank recapitalizations.

Her condition was support for one of Berlin's key demands - the establishment of a central supervision authority for banks run by the European Central Bank (ECB).

Agreed in Brussels, the details of how this new authority will work, what powers it will have and which banks it will supervise remain murky.

But its creation may ultimately be seen as a victory for Merkel and her vision of a united, integrated Europe with strict central controls. The loss of sovereignty it implies may only dawn on Monti, Rajoy and Hollande once EU officials put the meat on the bones of the plan in the second half of the year.

"The tone of the summit certainly made it look like a big defeat for Merkel, but on the substance of what was agreed I don't think it was," said Guntram Wolff, deputy director of the Brussels-based Bruegel think tank.

"The direct recapitalization of banks can only come once this new bank supervisory body is up and running. This has been her strategy all along - yes to aid, but only once the proper controls are in place."

EXPECTATIONS MANAGEMENT

Despite a hard-line reputation that has turned her into a figure of hate in Greece and led left-wing British magazine New Statesman to anoint her "Europe's most dangerous leader", Merkel has shown an unusual readiness to compromise on short-term crisis-fighting steps recently.

Last month Germany announced it was ready to grant Spain an extra year to reach its deficit reduction targets. German officials also broke a post-war taboo by signaling a tolerance for higher German inflation levels to help their southern European partners.

At the summit in Brussels, Merkel agreed that ESM loans to Spain would not have "preferred creditor status", a step that could slow a flight out of Spanish bonds by private investors.

But concessions to Italy were modest at best, with German officials vigorously rejecting claims by Monti that any future purchases of Italian debt by Europe's rescue fund would come with minimal conditions.

The 120 billion euro "growth pact" unveiled in Brussels was celebrated as a big win for Hollande, who pledged during his campaign for the French presidency to push back against Merkel's austerity policies and find new funds to support recession-hit economies along Europe's southern periphery.

But this victory was more symbolic that substantive. Much of the overall figure will come from already pledged, but unused, EU structural funds.

So why was the summit seen by so many as a major defeat for Merkel? Top-selling German newspaper Bild said the chancellor had been "blindsided" in Brussels, while influential weekly Der Spiegel wrote that she had become a "hostage" to southern euro states.

One reason may have been her need to maintain an ultra-hard line in the days leading up to the summit, to keep skeptical German lawmakers on-side ahead of votes on EU crisis measures on Friday, the last day before parliament's summer break.

Even after agreeing in the days before the summit to direct aid for banks, the EU sources said, the German side insisted it be kept quiet.

Had Merkel signaled a readiness to do a deal beforehand, the large majorities she needed on Friday in parliamentary votes on the ESM and "fiscal compact" on budget discipline may not have materialized.

"Merkel became a victim of her own expectations management," Der Spiegel said on Sunday.

In the end, German lawmakers had only hours to digest the summit results before voting. After threats of a delay and a raucous debate in the Bundestag chamber, they resoundingly backed the new crisis-fighting measures.

Still, more than two dozen deputies from Merkel's centre-right coalition rebelled and refused to support her, in a sign of growing unease in her conservative ranks.

The one area that European leaders did not find time to discuss in detail at their summit - Merkel's nascent drive to push Europe towards a form of "fiscal union" - is likely to dominate the second half of 2012 and could determine Merkel's political fate.

Within weeks, Germany's top court could rule that any additional steps towards closer European integration would require a change in Germany's constitution, or "Basic Law". That could lead to a national referendum on Merkel's pro-integration course.

Regardless, the debate is likely to dominate Merkel's campaign for a third term in the run up to a federal election in the autumn of 2013.

Setting up a common bank oversight authority is a first step towards the closer union Merkel says is needed to save the euro.

But as European leaders move towards finalizing a "road map" for such a union by a December deadline, she will have to convince partners like France and the Netherlands, who remain deeply skeptical about ceding sovereignty to Brussels, to go along with her.

"She is still in control," a senior European official said. "But a lot of countries are still waiting for her to spell out the details of her vision. There is a feeling she wants to move faster than others are comfortable with."

GlaxoSmithKline to pay $3 billion for health fraud

(AP) ? GlaxoSmithKline LLC will pay $3 billion and plead guilty to promoting two popular drugs for unapproved uses and to failing to disclose important safety information on a third in the largest health care fraud settlement in U.S. history, the Justice Department said Monday.

The $3 billion fine also will be the largest penalty ever paid by a drug company, Deputy Attorney General James M. Cole said. The corporation also agreed to be monitored by government officials for five years to attempt to ensure the company's compliance, Cole said.

"Let me be clear, we will not tolerate health care fraud," Cole told a news conference at the Justice Department. He would not say whether any company executives were under investigation. The company's guilty plea and sentence have to be approved by a federal court in Massachusetts.

"For far too long, we have heard that the pharmaceutical industry views these settlements merely as the cost of doing business," Acting Assistant Attorney General Stuart F. Delery, head of Justice's civil division, said at the news conference. "That is why this administration is committed to using every available tool to defeat health care fraud."

Delery added, "Today's resolution seeks not only to punish wrongdoing and recover taxpayer dollars, but to ensure GSK's future compliance with the law." He noted that a similar recent settlement with Abbott Laboratories also included continuing compliance monitoring.

It is illegal to promote uses for a drug that have not been approved by the Food and Drug Administration ? a practice known as off-label marketing.

Prosecutors said GlaxoSmithKline illegally promoted the drug Paxil for treating depression in children from April 1998 to August 2003, even though the FDA never approved it for anyone under age 18. The corporation also promoted the drug Wellbutrin from January 1999 to December 2003 for weight loss, the treatment of sexual dysfunction, substance addictions and attention deficit hyperactivity disorder, although it was only approved for treatment of major depressive disorder.

Justice Department officials also said that between 2001 and 2007 GlaxoSmithKline failed to report to the FDA on safety data from certain post-marketing studies and from two studies of the cardiovascular safety of the diabetes drug Avandia. Since 2007, the FDA has added warnings to the Avandia label to alert doctors about potential increased risk of congestive heart failure and heart attack.

The drug corporation also agreed to resolve civil liability for promoting the drugs Paxil, Wellbutrin, Advair, Lamictal and Zofran for off-label, non-covered uses. The company also resolved accusations that it paid kickbacks to doctors to prescribe those drugs as well as the drugs Imitrex, Lotronex, Flovent and Valtrex.

"GSK's sales force bribed physicians to prescribe GSK products using every imaginable form of high priced entertainment, from Hawaiian vacations to paying doctors millions of dollars to go on speaking tours to a European pheasant hunt to tickets to Madonna concerts, and this is just to name a few," said Carmin M. Ortiz, U.S. attorney in Massachusetts.

Of the penalties, $1 billion covers criminal fines and forfeitures and $2 billion is for civil settlements with the federal government and the state governments of Massachusetts and Colorado.

Highest-flying bird put to test

Bar-headed goose experiencing high altitude conditions in wind tunnel

Video footage of bar-headed geese in high altitude wind tunnel experiments has been released by researchers.

The flights were captured in super slow-motion by the University of British Columbia.

During "test flights", birds wear masks they are trained to wear as goslings, which provide them with oxygen levels that simulate high altitude.

The masks also collect gas that the birds breathe out, measuring how much precious oxygen they use in flight.

BBC Nature spoke to lead researcher Dr Jessica Meir at the Society for Experimental Biology's annual meeting in Salzburg.

Dr Meir explained that a great deal of research into the "remarkable geese" revealed how the birds are specially adapted to fly at extremely high altitude.

Their blood, for example, can carry far more oxygen to their muscles than other birds.

But while most studies have focused on the birds while they are at rest, Dr Meir wanted to create a "picture of oxygen delivery while the bird is flying".

Fortunately for her, the university's engineering department has a wind tunnel wide enough for a goose - with a wingspan of more than 1.5m - to fly in.

Tracking studies have recorded the birds at heights of 6,000m (just under 20,000 feet) - something they need to achieve in order to complete their migration through the Himalayas.

But, in order to find out just how high the birds could fly, Dr Meir and her colleagues recreated the oxygen and nitrogen levels that the birds would receive at 6,000m and at 9,000m above sea level. This is approximately 10% oxygen and 7% oxygen respectively.

At 7% oxygen, the birds are experiencing the conditions required to fly over the summit of Mount Everest.

Dr Meir told BBC Nature that she was interested in the physiology that allowed animals to cope in extreme environments and "do amazing things".

"I want to uncover the mechanism that allows these incredible physical feats to be accomplished," she said.

"We already know they fly at up to 6,000m, where the oxygen levels are half what they are at sea level.

"And they're not only able to function, they're able to fly, which is an incredibly expensive way of moving around; it takes 10-20 times more oxygen than when they're resting."

Dr Meir also hopes that understanding how bar-headed geese cope and perform at such low oxygen levels will help inform research into human respiratory problems.

Pakistan: US drone strike kills 8 militants

(AP) ? U.S. missiles fired from a drone in a Pakistani tribal region near the Afghan border killed eight suspected militants early Sunday, officials said, as the controversial American strikes continue despite Islamabad's persistent demands that they stop.

The latest attack killed fighters loyal to militant commander Hafiz Gul Bahadur, the officials said. Bahadur is believed by residents of the region to have an informal working relationship with the Pakistani army, refraining from targeting the security forces while focusing on U.S. and NATO forces in nearby Afghanistan.

The continued strikes, despite the likely political fallout, show Washington's confidence in the effectiveness of the drone program against al-Qaida and Taliban fighters who allegedly use Pakistan as a base.

Two Pakistani intelligence officials said four Hellfire missiles were fired at a house used by suspected militants in Dre Nishter village of North Waziristan. All the Pakistani officials spoke on condition of anonymity because they were not authorized to speak to the media.

The officials said some foreign militants belong to the Turkmenistan Islamic Movement were believed to have been killed, along with other local fighters from the Bahadur group. Militants from several central Asian countries have joined Afghans, Arabs, and others in Pakistan.

North Waziristan is one of several tribal areas along the border with Afghanistan that are hubs of militant activity. Bahadur controls most of North Waziristan.

The U.S. rarely talks publicly about the covert CIA-run drone program in Pakistan.

The drone attacks are a source of deep frustration and tension between the U.S. and Pakistan. Islamabad says they violate its sovereignty and also cause civilian casualties.

They complicate efforts to normalize the relationship between Washington and Islamabad, including reopening supply routes through Pakistani territory to NATO and American forces in Afghanistan. Islamabad blocked the routes after American airstrikes accidentally killed 24 Pakistani soldiers in November.

The U.S. in turn criticizes Pakistan for failing to crack down on fighters who stage attacks in Afghanistan.

Watch out! There's a lot of stuff up there...

This has been an extraordinary week for planets (moons), exoplanets, and astrobiology. I?m hard pushed to write properly about all these things but sometimes the sheer tidal mass of discoveries tells its own story.

And tidal masses is the first one up. This week new results from the Cassini mission around Saturn were presented in Nature (and discussed in this nice piece) that suggest Titan?s surface responds to the gravitational tides of Saturn by lifting and relaxing a substantial 10 meters in altitude. This indicates that Titan?s interior is quite flexible, in fact it indicates something that has long been suspected ? Titan probably has a subsurface ocean of liquid water, somewhere within 100 km of the surface. Sustained in part by radioisotope decay in Titan?s rocky core, this would be far from pure water, but water nonetheless.

A glimmering in the void (ESO/L. Calcada)

Far, far away, around a distant star called Tau Bootis, astronomers have now succeeded in obtaining the first direct measurement of the spectrum of light from the atmosphere of a hot Jupiter planet. All previous measurements of the atmospheric spectrum and composition of such worlds have come from data taken during transits of the parent star (where starlight serves as a brilliant back-light through the outer layers of atmosphere). By nailing the light coming directly from the plant known as Tau Boo b, astronomers have not only pinned down the planetary mass (by learning the orbital inclination relative to our viewpoint) but have set a precedent for the future. The direct measurement of light from exoplanets is one of the holy grails of astronomy? (yeah, there?s lots of these grails in science, I know).

And for another hot Jupiter, the planet HD 189733b (distinguished by transiting a star that at 63 light years away appears pleasantly bright in our skies, enabling lots of great observations to be made) has been observed to respond directly to a pummeling from a flare event on its parent star. In a stroke of luck the star underwent a large X-ray bright flare event just 8 hours before the transiting planet was observed with the Hubble Space Telescope. Unlike earlier measurements, this one showed a clear ?plume? or tail of atmosphere being lost by the planet ? adding it to the family of evaporating worlds, albeit periodically.

And finally (although I?ve skipped all sorts of other goodies, like peculiarly close super-Earth exoplanets that come as close as 1.2 million miles every 97 days), some more food for thought in the search for life elsewhere. Some new work indicates that the martian moon Phobos is in the direct line of fire for material that?s blasted off the martian surface by asteroid impacts. As this small moon scoots around Mars every 7.5 hours it can collect a significant amount of Mars filth. Why is this interesting? Well, it?s an awful lot easier to go and land on Phobos than it is to land on Mars ? so perhaps we should be thinking of sieving through the sands of Phobos in order to get a sampling of eons of Mars ejecta, and any possible microorganisms?
